The Similarity Index is a deterministic 0 to 100 number that measures how densely a searched mark overlaps with USPTO records on file. Exact mark hits on live registrations add 35 points, similar live marks add up to 45 points, and dead marks contribute up to 10 points. Tiers: LOW under 25, MEDIUM 25 to 49, HIGH 50 to 74, EXTREMELY HIGH 75 and above. It is a measure of data density, not a legal opinion about infringement or registrability. A licensed U.S. trademark attorney evaluates legal risk; the Index just shows you where the data clusters.

A score that drives decisions should be explainable. If your Similarity Index is 73, you should be able to look at the inputs and see exactly why. AI is used for narrative summaries, never for the Index itself. Determinism is the safeguard against hallucinated overlap.

A live trademark is currently registered or pending and can be enforced by its owner. A dead trademark has been abandoned, cancelled, or expired and no longer carries USPTO protection, although common law rights may still exist. Live marks are weighted more heavily in the Similarity Index.

The report is a precursor to a full clearance opinion and is meant to be handed off to a licensed U.S. trademark attorney for legal review.
